The Ministry of Road and Transport Development of Mongolia, intends to use part of the proceeds of a loan from/grant administered by the European Bank for Reconstruction and Development (the Bank). Contracts will be subject to the Bank's Procurement Policies and Rules.

This assignment is planned to be retroactively funded from the EBRD Loan.
The proceeds of the loan from/ grant administered by the Bank will be open to firms from any country unless otherwise specified and will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Client's country.
The Client now intends to establish a shortlist of qualified and competent consultants, with a view to inviting proposals from the shortlisted consultants, in relation to the assignment, on the basis of the procurement documentation provided in ECEPP for this assignment. The selection method (procurement method) is shown above and interested firms or groups of firms are hereby invited to submit expressions of interest.
The expected outcome of the assignment is as follows:
The Ministry of Roads and Transport Development as an Employer in the Works Contract (“Employer”) is willing to engage experienced international consultant in association with national companies as a Consultant (“Engineer”) to conduct supervision of the construction sites in accordance with FIDIC terms, the existing standard tender documentation of the Bank for procurement of works, as well as with the relevant local legislation on constructions. The Engineer will be engaged according to EBRD's Procurement Policies and Rules (“PP&R”) for consultancy services.
The selected consultant is expected to provide the following services:
The Consultant shall be required to administer the civil works contracts as the “Engineer” under the FIDIC Conditions of (Construction) Contract for Building and Engineering Works Designed by the Employer / ‘Red Book’ (1999), subject to certain requirements for the Engineer to seek the approval of the Employer prior to taking action under specified clauses of the Conditions of Construction Contract (limitations of Engineer’s powers will be specified in Sub-Clause 3.1 of the Particular Conditions of Contract.)
The Engineer shall be required to establish and follow detailed construction supervision procedures based on sound international practice, to monitor the completion of the project within the agreed programme and budget and to the quality standards and environmental provisions stipulated in the contracts. The Engineer shall carry out all supervision services for the Employer. To fulfill such requirements, the Engineer shall establish organizational structure during the construction Supervision services in accordance with all requirements for quality control, control of quantities, supervision of the work progress, analysis of expenses, and full implementation of environmental criteria as well as working on administrative questions during the construction and Defect Notification Period.
The Engineer shall perform the duties and authority of the Engineer as specified in or necessarily implied from the Construction Contract as well as administer the Construction Contract, dealing with situations in accordance with the Construction Contract, taking due regard of all relevant circumstances.
The assignment is expected to start on 18/06/2019 and have an estimated overall duration of 36 months.

In order to determine the capability and experience of consultants seeking to be selected, the consultant shall submit a response in accordance with the requirements of the procurement documentation available from the link in this notice. Following this invitation for expressions of interest, a shortlist of qualified firms will be formally established on the basis of the shortlisting criteria set out in the procurement documentation. Shortlisted consultants will be invited to submit proposals.
This consultant selection will be conducted by e-procurement using the EBRD Client E-Procurement Portal (ECEPP). Prospective participants who have registered in ECEPP and expressed an interest in the contract may access the documents and may request clarification and further information from the client through ECEPP. Other Information: All responses will be assessed based on the following Shortlisting Criteria:
a) Firm’s previous corporate project experience in construction (or reconstruction) supervision in the capacity of Engineer under the FIDIC Conditions of Contract – 35 %; In case of Joint Venture the Lead Partner shall satisfy at least 70 percent of this requirement and shall demonstrate that it successfully completed within time plan and budget.
b) Firm’s previous project experience in construction (or reconstruction) supervision of large-value road contracts in the capacity of Engineer under the FIDIC Conditions of Contract - 25%;
c) Firm’s previous experience in projects of similar nature (construction or reconstruction of roads or highways) implemented in similar climatic conditions (terrain, severe winter conditions resulting in short construction period, high precipitation and floods during construction period) – 10%;
d) CV of Key Experts (FIDIC Engineer (Team Leader), Deputy Engineer / Quality and Quantity Assurance Engineer, Contract/Claims Specialist) - 30%.
